Schools have a legal obligation to follow the Health and Safety Regulations, 1981. This means that employers must make sure that there is sufficient first aid provision. This covers both first aiders and equipment for first aid emergencies at work or on school trips. Employers also have to take care of the health and safety of non-employees who enter the school, such as parents.
The Health and Safety Commission (HSC) guidance suggests that organisations, such as schools, that provide a service for others should include them in their risk assessments and provide for them. Schools should consider carefully the possible risks to pupils and visitors, taking into account their legal responsibilities for those in their care.
The Department of Education states that it is up to Local Education Authorities and schools to create their own policies and procedures, based on an assessment of local needs and recommends a minimum provision of:
- A suitable stocked first aid box
- An appointed person to take charge of first aid arrangements
- Information for employees on first aid arrangements
- This minimum provision must be supplemented with a risk assessment to determine any additional provision taking into consideration the size of the school, number of employees, split sites etc
- Nurseries and primary schools need to comply with both HSE and Ofsted, EYES requirements
The school’s first aid needs should be reviewed regularly, at least annually to ensure that the first aid provision remains adequate for the school’s needs. Schools should ensure that their insurance arrangements provide full cover for claims arising from actions of staff acting within the scope of their employment.
